Terms of use StahlDat SX

StahlDat and StahlDat SX are online databases for technical information on steel materials, which are offered together with other information services at the addresses www.stahldat.de, www.steel-data.eu and www.stahldaten.de (hereinafter referred to as “address”).

A central component is the publication of the “Steel-Iron List” as a result of the work of the European Steel Registry, department of the Steel Institute VDEh in accordance with the specifications in EN 10027-2. Thus, StahlDat SX is the leading database for steel in Europe.

These “Terms of Use StahlDat SX” govern the use of the online databases offered at the address in the respective current version as well as all other online databases offered at the ‘address’ (all databases mentioned hereinafter referred to as ‘database’).

Matplus GmbH has taken over the exclusive marketing rights of the database from the Steel Institute VDEh.
Matplus GmbH has been commissioned with the marketing of the “Final reports of research projects from application research” (FOSTA reports) by the Forschungsstelle Stahlanwendung FOSTA e.V..
Unless otherwise stipulated in these Terms of Use, the General Licensing and Business Terms and Conditions (GTC) and the Data Protection Declaration of Matplus GmbH shall apply.

2. Conclusion of contract

2.1 The contract on the use of the database by the customer (database usage contract) is concluded as follows: After ordering in the online shop, by email, by letter or by fax regarding the desired database versions and modules, the contract is concluded with the sending of the access data for online access.

2.2 The database usage contract begins with the sending of the customer’s access data, at the latest, however, with the receipt of the invoice by the customer. The contract shall be automatically extended by 12 months if it is not terminated at least 30 days before expiry.

3. Scope of services/availability

3.1 The database enables the digital retrieval of technical data and facts on steel materials and their technologies. The concrete scope of services is determined by the type of database version modules or licences selected by the customer.

3.2 The database can be used with current standard web browsers, e.g. Firefox, Chrome, which correspond to the current state of the art (HTML5, Javascript, cookies). The customer is responsible for the use of suitable software (e.g. browser, internet access, virus protection).

3.3 Matplus endeavours to keep the database up to date at all times. The database and the software used for provision are subject to continuous technical and content-related maintenance, updating and further development.

3.4 Matplus is entitled to change and update the content of the database continuously and without prior notice. This also includes the right to remove data and data collections from the database in whole or in part.

3.5 The database is generally available 7 days a week x 24 hours a day. The availability corresponds at least to availability class 2 = 99%.

3.6 Matplus reserves the right to place advertising of any kind in the system environment of the database to a reasonable extent in a manner recognisable to the customer, both its own advertising and advertising from third parties.

4. Liability for defects, limitation of liability

The customer’s claims for damages or reimbursement of futile expenses are regulated in the GTC.

5.1 The databases of Matplus are protected by copyright. Matplus grants the customer a simple, non-exclusive, non-transferable and non-sublicensable right, limited in time to the duration of the database usage contract, if necessary with the number of personally bound workstations agreed in the database usage contract, to use the respective database (hereinafter “licence”). The use of the licence beyond this is not permitted.

5.2 The customer may only use the database for his own purposes. It is strictly prohibited to make the database accessible to unauthorised third parties or to pass on access data or database contents or parts thereof to unauthorised third parties.

5.3 The customer is prohibited from storing, digitally archiving or printing out parts of the database.

5.4 Excluded from 5.3 are project-related archiving of retrieved evaluations, illustrations, listings and other representations from the database, insofar as this is done to a reasonable extent and for internal company purposes.

5.5 The customer is not entitled to make changes to the extracts from the database, in particular to remove copyright notices, trademarks, serial numbers and/or other features serving to identify the programme from the contents and evaluations retrieved from the database.

6. General provisions

Furthermore, the General Licensing and Business Conditions (https://matplus.eu/en-us/general-terms-and-conditions/) and the Declaration on Data Protection (https://matplus.eu/en-us/privacy-policy/) shall apply.
